FISHING BOAT RENTAL TERMS & CONDITIONS

• You can reserve over the phone with a credit card by calling the office at 816-879-3460 or stopping by the store to pay in cash. You must leave a copy of your license and valid credit card on file in the event of incidentals prior to putting in the water.

1. That the boat is to be used solely by renter and his/her guests.

2. That the owner will not provide a refund for rental interruptions directly affected by renters' decisions/requests. We will provide a rain check valid for one year due to inclement weather out of our control.

3. That the fishing boat is not moved or trailered from Smithville Lake/Little Platte River. The boat will be delivered by BigFoote Outfitters to Boat Ramp 6 and picked back up at Boat Ramp 6 at the conclusion of the designated rental time.

4. That the renter has familiarized himself/herself with Smithville Lake and will not go into waters that are described on the map provided or discussed during your pre-rental orientation. Renter agrees to stay away from shallow waters and areas which may contain rocks and logs.

5. The renter is responsible for any damage from objects contacted during the use whether above water or below. Renter understands water recreation comes with unforeseen dangers which lurk below water.

6. That the renter will follow all State of Missouri boater safety rules and regulations during boat operation. Lifejackets, throw cushion, paddle, horn & marine fire extinguisher will all be provided and placed in the boat by BigFoote Outfitters.

7. That the fishing boat is not used to carry passengers for hire.

8. That the renter does not exceed the boater’s person capacity limit allowed on boat.

9. That the boat is not operated under the influence of drugs, alcohol or negligent manner.

10. That the only person to operate the fishing boat is the renter.

11. That the fishing boat is to be operated only in daylight hours.

12. That the fishing boat is not to be involved in any race context.

13. That no motor is to be mounted without permission of management.

14. That the fishing boat does not tow skiers or tubers as it is not equipped with a proper motor or towing setup.

15. That the fishing boat will be properly moored when not in motion, including use of provided equipment.

16. That the equipment stated as the contents of the fishing boat are present, and that the renter is responsible for any damage or missing contents regardless of reason that occurs during the rental period.

17. The renter has experience as to operation of a fishing boat and is familiar with the laws and safety requirements of operating the fishing boat, is 21 years of age and licensed motor vehicle operator. If renter was born after January 1, 1984, they must provide a valid Boating Safety Certificate Card prior to rental. Failure to provide a boater safety card will not be grounds for a refund.

18. The renter will ensure that all passengers will have properly fitted life jackets when using a fishing boat. These will be provided in the cost of the rental fee.

19. That renter has no mental or physical impairment that will interfere with the safe operation of the fishing boat.

20. Renter is responsible for all damage to fishing boats or to the property of others whether he/she is negligent or the cause of damage.

21. That renter is responsible for any and all injuries that occur to himself, herself, passengers or third parties during the rental period whether the renter was cause of injury.

22. The renter agrees to hold harmless BigFoote Outiftters LLC, owners & employees from any claim by a passenger or third party for any damage that arises from the use of the fishing boat during the rental period including attorney fees.

23. Renter consents to security deposit being applied to any damage to fishing boat, motor, prop, personal property of owner. Security deposit also applies to terms which are lost during the rental period. Renter is subject to any damage caused from “Acts of God” during the rental period. That renter acknowledges he/she is responsible personally for damages above and beyond security deposit. (see applicable charges for replacements due rental damage below)

24. That the fishing boat only includes one full tank of gas upon start of rental period. If renter runs the tank to empty there will be an incurred charge to the renter of $50 to come out and fill the boat back up.

25. That all trash shall be removed from the fishing boat at completion of rental period.

26. That the renter and his/her guests are responsible for purchasing a valid Missouri Fishing License and color coding their fish on lines inside the live well.

27. That if the renter experiences any trouble, he/she will call BigFoote Outfitters, LLC at 816-879-3460 for any help or call 911 for emergency help.

28. That the renter will return keys to BigFoote Outfitters LLC office or owner or employee at time of rental return.

29. That this agreement shall be binding on the renter’s heirs of assigns.

30. That renter has read and understood the terms of the agreement and acknowledges that he/she has been instructed by the owner as to the operation of the fishing boat and appropriate areas of operation.

31. That further, renter acknowledges that owner is renting upon renter answering the above in a truthful manner.
